Senior Counsel, Regulatory & Compliance
Modern Health is seeking a Senior Counsel, Regulatory & Compliance to join its legal team. This role involves providing strategic legal counsel on healthcare regulatory, privacy, AI, product, and compliance matters related to the company's digital mental health platform. The position reports to the Senior Vice President, Deputy General Counsel, Compliance & Privacy Officer, and collaborates closely with various departments, including clinical, product/engineering, security, operations, marketing, sales, people, and finance.
Key responsibilities include leading and providing practical, business-focused advice on healthcare regulatory issues, such as federal employer benefits regulations (e.g., ERISA, ACA market reforms), anti-kickback statutes, corporate practice of medicine, telehealth, professional licensure, and related state and federal laws governing mental health services. The role also involves counseling product, clinical, and operations teams on designing and launching products in compliance with legal requirements and industry best practices. Additionally, the Senior Counsel will manage and coordinate U.S. and international regulatory reviews for new offerings and market expansions, including engagement with outside counsel as needed.
The ideal candidate will have a Juris Doctor (JD) degree from an accredited law school and an active license to practice law in at least one U.S. jurisdiction. A minimum of 8 years of healthcare regulatory experience is required, ideally including both telehealth and pharmacy operations. The candidate should possess a deep understanding of healthcare laws and regulations, including telehealth compliance, FDA regulatory matters, compounding, and state-by-state professional practice standards. Demonstrated ability to interpret and advise on complex regulatory issues across care delivery, digital health, and pharmacy operations is essential. Strong communication and collaboration skills, along with exceptional organizational, analytical, and project management abilities, are also required.
